    Who Keeps White County Property Records

    County property records are public in Tennessee; the state’s Public Records Act ensures that Tennessee citizens may access any documents in county government that relate to real property. Three divisions of county government deal specifically with property in White County:

    County Trustee: Tax Bills and Payments

    The Trustee collects (Room 102). It’s a simple matter of scheduling; taxes are due and payable from October 1st and are paid at the rate established by the county ($2.05 per $100 of the assessed value). You can also pay in person, by mail, and online. Interest is compounded monthly after February.

    Property Tax in White County: Classification, Exemptions, and Appeals

    A parcel within the city limits of Sparta has its own city bill, in addition to the county taxes.

    Tennessee does not have a state tax rate; a White County tax bill would be one dollar and something of your home value, plus the city money you’ll owe if you’re within the city limits of Sparta, and it would begin with that something.

    How the bill is figured

    The residential and farm property is valued at 25 percent of the appraisal; commercial and industrial at 40 percent of the appraisal. The $40,000 assessed value and $820 county tax bill on the $160,000 White County home are based on an appraised home value of $2.05. The rate never reaches the appraisal.

    Foreclosure and Tax Sales

    Two sales, two trustees, one warning: they are not the same office.

    Deed-of-trust foreclosure

    When a default occurs, the substitute trustee under the deed of trust will notify the auctioneer to advertise and sell the property at a public auction as provided in Title 35 of the Tennessee Code. No judicial order is required; this private trustee has nothing to do with Room 102.

    Chancery Court tax sale

    Delinquent taxes are handled in a different manner. The county files a lawsuit in Chancery Court, and a court-ordered sale takes place, conducted by the Clerk & Master. A one-year redemption period is generally allowed to the delinquent taxpayer. In Tennessee, title to the property is transferred from the delinquent owner at the tax sale, which takes place in the state courts; tax-lien certificates are not used in Tennessee.

    How to Record a Document

    Following in the footsteps of the Tennessee Code (Title 66, Chapter 24):

    • Prepare the document in a Tennessee format with notarized signatures, a description of the property, and addresses of the preparer and return.

    • On the face of the deed, include White County’s two requirements: the tax parcel number and the signed, notarized Oath of Consideration.

    • Pay the recording fees plus recording taxes: $0.37 per $100 of the transfer and $0.115 per $100 on secured debt over $2,000.

    • Record a paper copy in Room 118 or have it mailed. Paper is the way to go until e-recording takes off; original returns are returned to you once the index is completed.
